MAIL-IN ORDINANCE VIOLATIONS

Those who have been charged with violating a City of DeKalb ordinance DO NOT NEED TO APPEAR IN COURT if you mail or deliver the full amount required to settle each charge against you within FOURTEEN (14) DAYS of the issuance of the complaint to the Legal Division of the City of DeKalb.  THERE ARE NO EXCEPTIONS TO THE FOURTEEN (14) DAY REQUIREMENT.  If you do not pay the full amount due within fourteen (14) days of the issuance of the complaint, the complaint will be filed with the DeKalb County Circuit Clerk and you will then have to appear in court.  If you are required to appear in court, in addition to a fine, you may be required to pay at least $60.00 in court costs.
 
ELIGIBILITY
YOU ARE NOT ELIGIBLE to participate in this program if you have pled guilty or have been found guilty of an alcohol-related offense or if you have utilized this program for an alcohol-related offense within the past 12 months.
 
METHOD OF PAYMENT
A. Payment by Mail:

1. Enclose the fine amount indicated by your charge in cashier's check, certified check or money order payable to the City of DeKalb. (NO PERSONAL CHECKS OR CASH ACCEPTED).

2. **Return the pink form after reading and completing the Waiver of Trial.

3. Mail to: City of DeKalb, Legal Division, 200 S. 4th Street, DeKalb, IL  60115

4. Use sufficient postage.

5. Mail sufficient time to be received within fourteen (14) days of the issuance of the complaint.

B. Payment in person:

1. Bring payment and the completed pink form to the City of DeKalb Legal Division, Room 204, 200 S. 4th Street, DeKalb, between the hours of 10:00 a.m. through 11:30 a.m. or 2:30 p.m. through 4:30 p.m. on normal business days (Monday through Friday excluding holidays).

2. Only certified check, cashier's check or money order will be accepted. (NO PERSONAL CHECKS OR CASH ACCEPTED.)

CONTESTING OF CHARGES
You have the right to contest the charge by appearing in court personally or through an attorney.  If you have questions regarding these matters, you should seek the advice of an attorney or you may contact the Legal Division at 815/748-2093.  You have the right to appear before a judge to enter a plea of guilty or not guilty.  If you enter a plea of not guilty, you  have the right to have a trial before a judge or jury.  You will also have the right to present a defense, confront witnesses, and have witnesses testify on your behalf.

Entering/Remaining in a Tavern as a Minor - $300 Keeping a Disorderly House - $100.00
Possession/Consumption of Alcohol - $200.00 Noise Violation - $50.00
Fighting Within the City - $150.00 Littering - $50.00
